Terms of Service
These Terms of Service govern your access to and use of Inksightful, including the website, mobile app, beta features, and related services operated by Brian's Brain, LLC ("Inksightful," "we," "us," or "our").
Inksightful helps you scan, recognize, organize, and search handwritten notebook content. It is a productivity and personal archive tool, not a system for emergency, legal, medical, financial, or other professional advice.
1. Acceptance of these terms
By using Inksightful, creating an account, joining the waitlist, or purchasing access or credits, you agree to these terms. If you do not agree, do not use the service.
2. Accounts and access
Some features may require Sign in with Apple or another supported sign-in method. You are responsible for keeping your account and devices secure and for all activity associated with your account.
Beta access, preview features, usage limits, and invitations may be changed, paused, or ended at any time. We may refuse, suspend, or terminate access if we believe these terms have been violated or if continued access would create risk for users, the service, or third parties.
3. Your content
Your scanned pages, recognized text, notebook entries, people, topics, and related metadata are your content. You keep ownership of your content. You give us a limited permission to process content you submit to Inksightful only as needed to provide, secure, maintain, and improve the service.
The app is designed around a local-first notebook database. When you choose cloud-based handwriting recognition or entry grouping, selected notebook content is uploaded to our backend and to AI service providers so the requested processing can run.
4. Acceptable use
You agree not to misuse Inksightful. For example, you may not:
- upload content you do not have the right to use or process;
- use the service to violate the privacy, intellectual property, or other rights of others;
- attempt to reverse engineer, disrupt, scrape, overload, or bypass security for the service;
- use automated access in a way that harms service reliability or other users;
- upload malware or content intended to interfere with the service.
5. AI-generated output
Handwriting recognition, diary grouping, people extraction, topic extraction, and similar features may use AI systems. AI output can be incomplete, inaccurate, or unexpected. You are responsible for reviewing output before relying on it.
6. Purchases, credits, and subscriptions
Inksightful may offer subscriptions, consumable credits, beta limits, or other paid features. Purchases made through Apple are also governed by Apple's terms and payment rules. Payment processing and entitlement management may be handled by third-party providers such as Apple and RevenueCat.
Consumable credits have no cash value, are not transferable, and are used only for eligible Inksightful processing features. We may refund or restore credits when a paid processing job fails, as described in the app or required by applicable law.
7. Privacy
Our Privacy Policy explains what information we collect, how we use it, and how notebook processing works. By using Inksightful, you also agree to the practices described there.
8. Intellectual property
Inksightful, including its software, design, branding, website, and documentation, is owned by Brian's Brain, LLC or its licensors. These terms do not grant you ownership of Inksightful or permission to use our branding except as needed to identify the service.
9. Third-party services
Inksightful may depend on third-party services for sign-in, email waitlists, payments, entitlement management, cloud hosting, AI processing, analytics, notifications, and support. Those services may have their own terms and privacy policies.
10. Changes to the service or terms
We may update the service and these terms from time to time. If changes are material, we will provide notice through the website, app, email, or another reasonable method. Continued use after changes take effect means you accept the updated terms.
11. Disclaimers
Inksightful is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.
12. Limitation of liability
To the fullest extent allowed by law, Brian's Brain, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or service interruption. Our total liability for any claim related to Inksightful will not exceed the greater of the amount you paid us for the service in the three months before the claim or USD $100.
13. Governing law
These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, unless applicable law requires otherwise.
